Haven't had a chance to read it yet, but am really looking forward to it. Tim Robbins Attacks Television

Even as he came on stage to give the keynote address at the National Association of Broadcasters Show in Las Vegas, it was obvious that Tim Robbins' remarks had caused controversy backstage. The Academy Award-winning actor and critically acclaimed screenwriter, director and producer first indicated to the audience that he would not be giving his speech. Then, floor agents of the NAB organizers ordered journalists' video cameras turned off. An NAB spokesman later said Mr. Robbins contract had a "no filming" clause. Psystar - Apple Mac Clone?

Apple may have a hard time shutting down the new maverick Mac-clonemaker Psystar, say legal experts. Psystar, a Miami-based IT services company, started advertising the $400 OpenComputer this week. It's a generic PC that comes with Leopard, Apple's latest operating system, pre-installed.

And while Psystar may be violating Apple's end user license agreement, or EULA, by doing this, legally there's not much Apple can do about it, says Raj Abhyanker, a patent lawyer who used to write patents for Apple.

"Basically, when people go to a store or download software, they have a license with Apple to use this patented software on their computer. But breach of contract is one of the weakest forms of legal disputes," Abhyanker says, referring to EULA violations.

The emergence of an unlicensed Mac clonemaker is a sign of Apple's growing market power. The Cupertino company sold more than 2.3 million Macs during the first quarter of 2008 -- a growth rate that's more than 2.5 times that of the overall PC market, according to research firm IDC. Apple had an official clone-licensing program in the mid-1990s, but Steve Jobs killed it in 1997 after returning to lead Apple. [by Brian Gardiner, Wired]    UPDATE

Public Domain Video Remixes

Total Recut provides access to hand picked public domain video footage from the Internet Archive in our materials section that you can download and use in your own remixes. It seems that a lot of people are using this footage, specifically from the Prelinger Archives, to create new remixed video art and films. There is a hige amount of creativity being demonstrated. The Internet Archive hosts a section called 'Prelinger Archive Mashups' that contains remixed videos that use footage from the Prelinger collection. Check it out here.    UPDATE
 




New Zealand's Digital Copyright Law

New Zealand passed its digital copyright law this week, drawing the ire of the technology community and the blogosphere. While the bill isn't great, many of the provisions are far better than what Industry Minister Jim Prentice may have in mind for Canada including format and time shifting provisions as well as anti-circumvention provisions that are more flexible than those found in the DMCA. In fact, the anti-circumvention provisions are arguably the best of any country, since they are compliant with WIPO, limited in scope, and seek to preserve fair dealing rights.

While this bill is far from perfect, it is light years ahead of what Canadians were likely to get last December. Moreover, the combination of the recent Israel law (fair use) and the New Zealand law (flexible anti-circumvention), re-affirms that there is considerable copyright reform flexibility and that major countries around the world are taking advantage of that flexibility notwithstanding U.S. pressure. EFF on Universal Music's Absurdity

Electronic Frontier Foundation's Fred von Lohmann informs us: "In a brief filed in federal court yesterday, Universal Music Group (UMG) states that, when it comes to the millions of promotional CDs ('promo CDs') that it has sent out to music reviewers, radio stations, DJs, and other music industry insiders, throwing them away is 'an unauthorized distribution' that violates copyright law. Yes, you read that right -- if you've ever received a promo CD from UMG, and you don't still have it, UMG thinks you're a pirate.

UMG seems to think that the "promotional use only" label somehow gives it "eternal ownership" over the CD. While this might make sense to a goblin living in Harry Potter's world, it's not the law under the Copyright Act. According to the first sale doctrine, once a copyright owner has parted with ownership of a CD, book, or DVD, whether by sale, gift, or other disposition, they may not control further dispositions of that particular copy (including throwing it away). It's thanks to the first sale doctrine that libraries can lend books, video rental stores can rent DVDs, and you can give a CD to a friend for their birthday. It's also the reason you can throw away any CD that you own.

Asia Fights for Web Rights

"In November 2007, Yahoo! Inc. did what it could have done two years ago when it became known that the company had aided the 2005 conviction of Chinese journalist Shi Tao, now serving 10 years in prison for “revealing state secrets.” In a legal settlement, Yahoo pledged to provide an undisclosed amount of “financial, humanitarian and legal support” to the families of Shi Tao and Wang Xiaoning, another dissident jailed in 2003 for 10 years with the help of email data supplied by Yahoo. This came immediately after Yahoo cofounder and chief executive officer, Jerry Yang, made a dramatic public apology to Shi Tao’s mother, Gao Qinsheng, at a United States Congressional hearing.
